Terms of Service

These Terms of Service ("Terms") govern your use of the website clearcandidates.com (the "Site") and AI voice agent services ("Services") provided by Alastor Global LLC, doing business as Agentic Solutions ("we," "us," or "our"). By accessing the Site or using our Services, you agree to these Terms.

1. Services

Agentic Solutions provides AI-powered voice agent technology ("Christine") that answers phone calls, books appointments, qualifies leads, and handles customer inquiries on behalf of subscribing businesses ("Clients"). Our Services include voice agent configuration, knowledge base setup, CRM integration, and ongoing management.

2. Eligibility

Our Services are available to businesses and individuals who are at least 18 years old and have the legal capacity to enter into binding agreements. By using our Services, you represent that you meet these requirements.

3. Pricing and Payment

Setup Fee

A one-time, non-refundable setup fee of $2,500 is due before any work begins. This covers custom voice training, CRM integration, knowledge base configuration, and phone number provisioning.

Monthly Subscription

  • Essential: $497 per month
  • Professional: $997 per month
  • Enterprise: $1,497 per month

Minimum Commitment

All plans require a 3-month minimum commitment. After the initial 3-month term, your subscription auto-renews on a monthly basis. You may cancel with 30 days written notice after the minimum commitment period. In accordance with New York General Obligations Law Section 5-903, we will provide written notice 15-30 days before each auto-renewal.

Payment Terms

Monthly fees are billed in advance on the first of each month. Payments are processed through Stripe. Late payments may incur a fee of 1.5% per month on outstanding balances. We reserve the right to suspend Services after 15 days past due.

4. AI Disclosure

Christine is an artificial intelligence system. While Christine is designed to deliver natural, professional conversations, she is not a human being. In compliance with FTC guidelines and applicable state laws:

  • Christine identifies as an AI assistant when directly asked
  • All calls include a recording disclosure
  • Christine does not provide medical, legal, or financial advice
  • Christine may occasionally make errors or misunderstand callers

5. Client Responsibilities

As a Client, you agree to:

  • Provide accurate and current business information for Christine's knowledge base
  • Promptly notify us of changes to your services, pricing, hours, or other business details
  • Review call analytics and report any issues within a reasonable timeframe
  • Not direct Christine to perform actions outside her authorized scope
  • Comply with all applicable laws and regulations in your industry

6. Intellectual Property

All technology, software, algorithms, voice models, scripts, and systems used to deliver our Services are and remain the exclusive property of Alastor Global LLC. Clients receive a non-exclusive, non-transferable license to use the Services during their active subscription. Client-provided business information remains the property of the Client.

7. Limitation of Liability

To the maximum extent permitted by New York law, our total liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.

This limitation does not apply to liability arising from fraud, willful misconduct, gross negligence, or bad faith, as required by New York law.

8. Warranty Disclaimer

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that Christine will answer every call perfectly, book every appointment correctly, or generate any specific business results. AI technology is inherently imperfect.

9. Confidentiality

Both parties agree to keep confidential any proprietary information received during the course of the business relationship. This obligation survives for 2 years following termination of services.

10. Data Handling

Please refer to our Privacy Policy for information about how we collect, use, and protect your data and the data of callers who interact with Christine.

11. Termination

Either party may terminate for cause if the other party materially breaches these Terms and fails to cure within 30 days of written notice. We may suspend Services immediately if:

  • Payment is more than 15 days past due
  • Client directs Christine to perform prohibited activities
  • Client's use of Services violates applicable law

Upon termination, access to Services ceases and any outstanding fees become immediately due.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through the following process: (1) good-faith negotiation for 30 days, (2) mediation for 30 days, and (3) binding arbitration for claims under $250,000. All proceedings shall take place in Richmond County, New York. Both parties waive the right to a jury trial.

13. Governing Law

These Terms are governed by the laws of the State of New York without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify existing Clients of material changes at least 30 days before they take effect. Continued use of our Services after changes become effective constitutes acceptance of the updated Terms.
